These Terms of Service ("Terms") govern your access to and use of BuildAGallery (the "Service"), operated by Ivan Gavrilov, an independent sole trader registered in Belgium ("we", "us", "our").
By creating an account or using the Service, you agree to these Terms.
BuildAGallery is a platform that allows users to upload, store, manage, and share photo, video, and audio galleries, including optional AI-powered features such as audio transcription and content generation.
You must be at least 18 years old to use the Service.

By uploading content, you grant us a limited, non-exclusive, non-transferable license to process and store the content solely to operate and provide the Service.

AI features are provided as optional tools.
Uploaded content processed by AI is used only to deliver the requested feature (e.g. transcription, title or summary generation). We do not use user content to train our own AI models.
AI-generated outputs are provided "as is" and may contain inaccuracies.
Our order process is conducted by our online reseller Polar.sh. Polar.sh is the Merchant of Record for all our orders. They are responsible for processing payments, managing tax compliance (including VAT), and handling billing-related customer inquiries. By subscribing to a paid plan, you agree to Polar.sh's Terms of Service.
By choosing a paid plan, you authorize Polar.sh to charge your chosen payment method on a recurring basis (monthly or annually) at the then-current rate. Subscriptions renew automatically until canceled. You may cancel your subscription at any time via your account settings; cancellation stops future billing but does not trigger an automatic refund for the current billing period.
In accordance with EU consumer law, residents of the European Union have the right to withdraw from their initial subscription within 14 days of purchase.
BuildAGallery extends this 14-day money-back guarantee to all users worldwide. If you are not satisfied for any reason, you are entitled to a full refund within 14 days of your initial purchase. For detailed instructions on how to exercise this right, please visit our Refund Policy.
BuildAGallery offers a referral program where users can earn additional storage capacity ("Bonus Storage"). By participating in this program, you agree to these terms and conditions.
Bonus Storage is granted when a new user signs up via your unique referral link and successfully completes the email verification process. Both the referrer and the referred user will receive 500MB of storage. This bonus is capped at a maximum of 10GB of total earned storage per account, which is added to the base storage of your current subscription tier.
For users on the Free Tier, the "Powered by BuildAGallery" badge is a mandatory component of the Service and serves as an automated referral vehicle. Attempting to hide, remove, or tamper with this branding (e.g., via custom CSS or scripts) is a violation of these Terms and may result in the immediate removal of all Bonus Storage or account termination.
Bonus Storage is granted at our sole discretion and is subject to verification. We reserve the right to audit, reset, or revoke any Bonus Storage and/or suspend accounts found to be engaging in:
If suspicious or fraudulent activity is detected, we may reduce your storage limit to the base level of your current plan without prior notice.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability.
To the maximum extent permitted by law, we shall not be liable for:
Our total liability shall not exceed the amount paid by you for the Service in the previous 12 months.
You may cancel your account at any time. We may suspend or terminate access for violations of these Terms.
These Terms shall be governed by and defined following the laws of Belgium. BuildAGallery and yourself irrevocably consent that the courts of Belgium shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
